Improving the state: critical remarks on a constitutional reform foretold

This article deals with the Romanian constitutional reform in preparation, focusing especially if there is a chance to improve the state organization and state efficiency in the given political context by the means of a constitutional engineering. Two\r\nmain issues are discussed by the author: the inherent conflicts between the President and the Prime Minister in the Romanian semi‐presidential system and the misused possibility of the Government to adopt ordinances with the force of the law in certain contexts, which modified the balance of powers between Parliament and Government. The author gives personal opinion on the best solutions as well, but also shows what the expected and maybe not so ideal answers to Romania’s constitutional problems are.
